If you were injured during the course of your employment, you are entitled to collect workers’ compensation benefits, regardless of who was at fault for the accident. The claims process has many requirements and milestones that must be met.
For example, the workers’ compensation claims process in New York requires an injured employee to notify their supervisor about the accident as soon as possible, but no later than 30 days.
Also, within 48 hours of the accident, a preliminary medical report must be submitted to the Workers’ Compensation Board and to the employer. Further, an employee must file a claim with the Workers’ Compensation Board within two years of the accident.
Once a claim is filed, the workers’ compensation insurance company benefits must be paid within 18 days, as long as the employee missed seven or more days from work. The workers’ compensation insurance company must notify the Workers’ Compensation Board of any reason why payments are being denied.
Applying for Social Security Disability benefits requires the filing of an application with the Social Security Administration. Your application must be accompanied with all medical evidence and documentation concerning your financial assets.
Approximately 70% of initial Social Security Disability applications are denied upon initial review. However, you have the right to appeal the denial and request that the decision be reconsidered. You have the right to request a hearing before an administrative law judge for your appeal.
